These General Terms of Use (hereinafter the “Terms”) govern access to and use of the website https://rightkeeper.io and the services offered by Rightkeeper (hereinafter “Rightkeeper”).
Rightkeeper offers a SaaS platform that enables, in particular:
The deposit and storage of digital files;
The calculation of a digital fingerprint identifying a file;
The time-stamping of information associated with files;
The generation of certificates summarising information about deposits and the proofs created;
Secure file sharing with third parties;
The creation and sharing of proof folders, depending on the plan subscribed.
The features available depend on the plan chosen by the user.
Rightkeeper does not currently offer a legal contract generation service.
The service is available online, subject to interruptions required for maintenance, technical incidents, force majeure or any other circumstance beyond Rightkeeper’s control.
Users are responsible for their computer equipment, their internet connection and the security of their login credentials.
Using features that require an account involves creating a user account.
Users undertake to provide accurate information and to keep it up to date. They are responsible for the confidentiality of their credentials and for operations carried out from their account, subject to applicable legal provisions.
Users undertake to:
Use the service in accordance with applicable law;
Hold the necessary rights and authorisations for the files they deposit or share;
Respect intellectual property rights and the rights of third parties;
Not deposit or share unlawful content;
Not compromise the security, integrity or proper functioning of the service;
Ensure that the people they share files with are authorised to access them.
Users remain responsible for the files they deposit, their content and the conditions under which they share them.
The elements making up the Rightkeeper website and platform, including texts, graphics, logos, interfaces, software and source code, are protected by applicable intellectual property law.
Subject to third-party rights, they remain the property of their respective owners.
Depositing a file on Rightkeeper does not transfer to Rightkeeper any intellectual property rights the user holds in that file.
Rightkeeper provides technical features for documenting certain information about deposited files, including their digital fingerprint and the associated dating information.
The certificates generated by the service summarise the technical elements relating to the deposit and the proof created.
On their own, these elements do not certify authorship, ownership of intellectual property rights or the originality of a creation. Their scope and probative value are assessed in light of the context and applicable law.
Users remain responsible for how they use the certificates and other elements obtained through the service.
Rightkeeper uses reasonable means to ensure the operation of the service, without guaranteeing uninterrupted availability.
To the extent permitted by law, Rightkeeper cannot be held liable for damage resulting in particular from improper use of the service, inaccurate information provided by the user, unauthorised use of the user’s credentials or circumstances beyond its control.
This article does not exclude or limit liability where the law prohibits such exclusion or limitation.
Rightkeeper reserves the right to amend these Terms to reflect changes in the service, its features or the applicable legal framework.
Users will be informed of changes by appropriate means, in particular via the website, the platform or by email where necessary.

These General Terms of Sale (hereinafter the “Terms of Sale”) apply to any subscription to a paid Rightkeeper plan by a business or consumer customer (hereinafter the “Customer”). They supplement the General Terms of Use, which apply to all users of the service.
Any subscription implies prior and unreserved acceptance of the Terms of Sale and the Terms of Use, confirmed by ticking a box when ordering. In the event of a conflict, the specific terms of a Custom plan prevail over these Terms of Sale.
Rightkeeper SAS, a simplified joint-stock company with share capital of €1,000, registered with the Agen Trade and Companies Register under number 991 272 477, with its registered office at 348 route de la Marchande, 47310 Sérignac-sur-Garonne, France. Contact: contact@rightkeeper.io.
Free: free plan for creating up to 10 proofs.
Pro: monthly subscription for depositing up to 100 GB of files, with proof folders and share tracking. Additional storage may be offered.
Custom: plan for teams and organisations, on quotation and governed by specific terms.
The features of each plan are detailed on the Pricing page of the website.
Prices are shown in euros, including all taxes. The Pro plan costs €9.90 including VAT per month. Invoices issued to business customers show the amount excluding tax and the applicable VAT.
Rightkeeper may change its prices. Any change is notified to the Customer at least 30 days before it applies; a Customer who does not accept it may cancel their subscription before that date at no cost.
To subscribe, the Customer creates an account, chooses a plan, checks the order summary, accepts the Terms of Sale and Terms of Use, then pays. A confirmation email is sent. The contract is concluded upon receipt of this confirmation.
Payment is made by card through the payment provider Stripe. Rightkeeper has no access to the Customer’s banking details. The subscription is charged every month on the anniversary date of the subscription.
If a payment fails, the Customer is informed by email. If the situation is not resolved within [To be completed: 15 days], Pro plan features may be suspended.
For business customers, any late payment automatically incurs late payment penalties equal to three times the French statutory interest rate and a fixed recovery fee of €40 (articles L441-10 and D441-5 of the French Commercial Code).
The Pro subscription runs for one month and renews automatically. There is no commitment: the Customer can cancel it at any time from their Rightkeeper account, using the dedicated cancellation feature, or by writing to contact@rightkeeper.io.
Cancellation takes effect at the end of the current monthly period. Amounts already paid are not refunded pro rata. When the subscription ends, the account returns to the Free plan, without the 10 free proofs: any new deposit requires subscribing to a paid plan. The Customer keeps access to their existing files and certificates, which they can download or delete under the conditions of article 9.
Rightkeeper may terminate the contract in the event of a serious breach of the Terms of Use or Terms of Sale by the Customer, after formal notice that remains unanswered for 15 days, except in urgent cases or for manifestly unlawful content.
Consumer Customers have 14 days from subscription to exercise their right of withdrawal, without giving a reason, by sending an unambiguous statement to contact@rightkeeper.io. This right also applies to business customers with no more than five employees, where the contract falls outside the scope of their main activity.
If the Customer expressly requests that the service start before the end of this period, they remain liable, in the event of withdrawal, for an amount proportional to the service provided until they communicated their decision. Refunds are made within 14 days, using the same payment method.
The Customer can, at any time and in particular upon cancellation, download their files and certificates from their account and request the deletion of their data.
Deleting a file. The Customer can delete a file at any time from their account. Deleting a file does not delete the proof: Rightkeeper deletes the physical file and anonymises the associated metadata. The fingerprint written to the blockchain remains.
Closing the account. The Customer can close their account at any time: their files, certificates and account data are then deleted under the same rules. The Customer is responsible for downloading their files and certificates beforehand, as Rightkeeper will no longer be able to provide them afterwards.
The processing of personal data is described in the Privacy Policy.
Rightkeeper uses reasonable means to ensure access to the service, subject to maintenance operations and technical incidents. Consumer Customers benefit from the statutory warranty of conformity applicable to digital content and services (articles L224-25-12 et seq. of the French Consumer Code).
The scope of digital proof and Rightkeeper’s liability are set out in articles 6 and 7 of the Terms of Use. With regard to business customers, and except in cases of gross negligence or wilful misconduct, Rightkeeper’s total liability is limited to the amounts paid by the Customer during the 12 months preceding the event giving rise to the claim.
In the event of a dispute, consumer Customers must first send a written complaint to contact@rightkeeper.io. If no amicable solution is found within two months, they may refer the matter free of charge to the consumer mediator Rightkeeper is registered with: [To be completed: mediator’s name, website and address].
These Terms of Sale are governed by French law. Any dispute with a business customer falls under the exclusive jurisdiction of the courts within the jurisdiction of the Agen Court of Appeal. Consumer Customers may, at their choice, bring proceedings before the court of the place where they lived when the contract was concluded or where the harmful event occurred.
Rightkeeper may amend these Terms of Sale. The applicable Terms of Sale are those in force on the date of subscription; any substantial change is notified to the Customer at least 30 days before it takes effect.
